Psilocybin as Our Sacrament and The Current Legal Landscape
What Does the Legal Landscape look like?
-Entheogens-(plant medicines) are currently decriminalized in Arcata and Eureka CA, where HHC operates. Humboldt County is soon to become decriminalized.
-When the United States was formed, one of the foundational premises was the First Amendment of the U.S. Constitution:
The Freedom of Religion.
-The First Amendment prohibits the government from burdening religion and the exercise of religious beliefs.
-RFRA Stands for Religious Freedom Restoration Act. RFRA was in response to a U.S. Supreme Court case in 1993 that removed the ability to dispute a law that did not explicitly limit the exercise of religion.
-Under RFRA, consistent with strict scrutiny, the government shall not substantially burden the exercise of religion, except when the law is in the furtherance of a compelling governmental interest and is the least restrictive means of doing so.
-Hypha Humboldt Community has the right to federal claims and defenses under the Religious Freedom Restoration Act (RFRA) to protect its right to religious exercise the First Amendment of the Constitution of the United States of America.
-Hypha Humboldt Community operates as a church. We honor the elements: Air, Fire, Earth and Water. We celebrate our ceremonies on the equinoxes and solstices and other holy days of celestial transitions. We believe that our sacrament psilocybin must be present at these ceremonies in order to connect with the divine.
Why a church?
-Psychedelic Non Profit Churches Restore Connection For Those Who Feel Isolated. We serve those who long for community, purpose and belonging. We are non dogmatic, egalitarian, and believe in animism. We believe the church path keeps the sacrament sacred. We are not here to make a profit or sales off of our retreats or sacraments.
-While we support the widespread use of psychedelics-we are neither participating in the market for psychedelic mushrooms nor psychedelic therapy. We are a church offering a sacred sacrament, education, integration and ceremony to those that seek to be a part of our religious community.
-Psilocybin containing mushrooms provide mental, physical and spiritual restoration where western culture and medicine has fallen short.
-We are the new paradigm that addresses depression, anxiety and severed belonging through ceremony and community through our sacrament, psilocybin.
-Hypha Humboldt Community addresses the needs for trust, connection with nature, healthy mind and psyche, community, ritual, ceremony, spirituality, and creativity. Our beloved psilocybin allows us to restore these pieces that make each of us whole.
